Some new details have surfaced in the lawsuit lodged by celebrity artists against Epic Games and Fortnite for copyright infringement. It has been revealed that the US Supreme Court ruled that the plaintiffs suing for infringement for their dance moves cannot pursue legal recourse, as their work is not registered with the US Copyright Office.

While this would naturally lead to a trip down to the US Copyright Office to trademark their respective dance moves, The Fresh Prince of Bel-Air actor Alfonso Ribeiro seemingly came up against a wall with his efforts, with the office refusing to copyright the Carlton dance “because the work submitted for registration is a simple dance routine.”

In the wake of the recent ruling, The Hollywood Reporter revealed that Ribeiro, 2 Milly, Orange Shrit Kid and The Backpack Kid have all voluntarily dropped their lawsuits. That said, the law firm representing them said that it was a “purely procedural” matter, and that all of the suits will be re-filed once their Copyright Office registrations have been completed. How they’ll be able to do this given Ribeiro’s recent failure to do so remains to be seen. “We will continue to vigorously fight for our clients’ rights against those who wrongly take their creations without permission and without compensation,” attorney David Hecht said to THR.

Fortnite is now available for PC, PlayStation 4, and Xbox One.
