RuneScape Player Sues Developer Jagex For Being Muted, Loses

While much of the gaming industry focuses on the newest and latest titles, there are still pockets of fandom that manage to keep perennial classics alive. One such internet favorite has been the ongoing MMORPG RuneScape, which continues to attract a large userbase and has even been ported to mobile devices to attract even more new players. However, like any popular MMORPG, developer Jagex has had to find ways to delicately deal with problematic users, using methods such as suspensions and muting. Recently though, one RuneScape player tried to sue Jagex for muting him, but the law ultimately was not on his side.

Recently reported by Eurogamer, UK-based publisher Jagex Inc. became the subject of a lawsuit after Pennsylvania man Amro Elansari had his Runescape account muted around March of last year. Elansari stated in the handwritten suit that he regularly played and streamed the game for over 2,000 hours and thus felt being muted violated his ability to express free speech. The claims made against Jagex were swiftly dismissed by a district court judge, but Elansari ultimately tried to submit the suit to the U.S. Court of Appeals, largely presenting the muting as a discriminatory offense. The court has now delivered a final ruling on the case, stating:

“Even generously construing Elansari’s complaint to raise a claim of public accommodations discrimination and assuming that Elansari can bring such a claim in this context, at no point either in the District Court or on appeal has Elansari alleged losing access to Jagex’s online game due to discrimination based on any of the grounds protected by Title II.”

Jagex regularly mutes individuals for violating Runescape’s official Terms and Conditions, so it would be doubtful that Elansari was dealt with in a manner different from muting cases in the past. Also worth noting, it seems that Elansari has also attempted similar frivolous suits in the past, including one directed at dating app Tinder. For this case though, it seems that the law has spoken and ended any chances of Elansari’s claims being taken with merit. I guess Elansari will be a silent warrior for the foreseeable future.
