With Guardians of The Galaxy Vol. 2 proving to be just as fun and entertaining of a movie as the original (if not more so), it makes perfect sense for Marvel fans across the world to take their significant others to see the film. This is exactly what a 37-year-old Texas man had in mind when he took a woman he met online to see the movie on their first date. In a plot twist worthy of the big screen, Brandon Vezmar is now suing his date for $17.31 – the price of his ticket – after she reportedly texted several times during a 3D screening of Guardians 2. In a statement he made to The Statesman, the Guardians 2 viewer claims that “it was kind of a first date from hell” as about 15 minutes after the movie began his date “activated her phone at least 10-20 times in 15 minutes to read and send text messages.”

“This is like one of my biggest pet peeves.”

Hoping to not have his movie experience ruined Vezmar asked his date to stop, but she refused. He then suggested that perhaps she could go outside to text. She then left the theater and never came back, according to the Guardians 2 viewer. She also took her car which they both had taken to the theater, leaving him stranded without a ride. Vezmar said he texted her a few days later asking that she pay for the price of the ticket, but refused to pay. The petition filed by Vezmar states that the texting was a “direct violation” of the theater’s policy and that his date “adversely” affected the viewing experience of both the Guardians 2 viewer and those around him. “While damages sought are modest, the principle is important as defendant’s behavior is a threat to civilized society,” the petition says.  

As with any story, though, there are always two sides. According to Vezmar’s date, she only texted on her phone during the movie “two or three times”.  She was apparently texting her friend who was having a fight with her boyfriend. “I had my phone low and I wasn’t bothering anybody.  It wasn’t like constant texting.” She plans on filing for a protective order against Vezmar, as he allegedly contacted her little sister in order to get his money back for the movie ticket.  “I’m not a bad woman,” she later added. “I just went out on a date.”

After the original report went viral, Guardians of the Galaxy Vol. 2 director James Gunn weighed in on the situation via Twitter, saying “Why stop at suing?  She deserves jail time!” He is, of course, kidding. We can’t blame him for joking about the lawsuit as the entire story reads like satire. Apart from the date’s need to file for a protective order against Vezmar, the entire situation could be shrugged off as a lousy first date experience to tell the grandkids.

Thankfully, this story seems to have a happy ending. Alamo Drafthouse CEO Tim League has offered Brandon Vezmar a $17.31 gift certificate to settle the lawsuit, if he agrees to drop the case.

“To save the time of the courts, the Alamo is willing to help put this to bed and hereby offers Vezmar a gift certificate in the amount of $17.31 for his next cinema outing.”

Hopefully Vezmar’s next ‘cinema outing’ is a more enjoyable experience, and any future dates of his know what to expect when accompanying him. So, thoughts on the story? Who would you side with?
