Skrulls Can and Do Exist in the Marvel Cinematic Universe – James Gunn Explains How

Some comic and MCU (Marvel Cinematic Universe) fans may be scratching their heads about the inclusion of the Skrulls in the Captain Marvel film announced during San Diego Comic-Con 2017. Unfortunately, this isn’t the first instance of him having to explain the legal ownership and rights affiliated with another IP holder. The question has been asked multiple times since 2012. Yes, it is the exact same Skrull race that belongs to Fox’s The Fantastic Four and X-Men franchises. They’re also green and have the ability to shapeshift. Legally, Skrulls “as a whole” can be used within any Marvel series, but “specific” characters cannot.

A separate Twitter user inquired further, wondering why Fox doesn’t just allow the use of an originally Marvel race to be allowed into the MCU. Understanding of the reason behind why the X-Men universe cannot traverse to the other side, the user didn’t see a problem with allowing The Fantastic Four in on it. Gunn responded by stating, “For the same reason I don’t give my car to my next door neighbor.”

In other words, even though the Skrull were originally created by Marvel, it was sold long ago to Fox. Once you’ve sold something, the privilege of utilizing said item is no longer there. However, if the person you sold to was a good friend or “neighbor”, they may be kind enough to let you borrow it from time to time. Or there was some kind of agreement for sharing the car within the contract then that’s a different, which is likely the case here.
